Terms of service

Terms of Service

Effective October 22, 2026

The short version: Play fair, keep your name clean, and don't cheat or copy our games. Purchases go through the App Store or Google Play, and so do refunds. In-game coins and HASH aren't money. We'll keep improving the games, which sometimes means changing them.

These terms cover every Gigawatt Games app (Botsy, Byte Back, Hoop Rocket, Sugar Rush, Tilt Tank, OVERCLOCK) and gigawattgames.com. Gigawatt Games is the games label of Clocktower Development LLC ("we", "us"). By downloading or playing one of our games, you agree to these terms and to that game's privacy policy. If you don't agree, please don't use the game.

Age and parents

If you're under 18, or under the age of majority where you live, a parent or guardian needs to agree to these terms for you. Botsy is made for kids ages 6 to 11; parents agree on their behalf. Some of our games have their own age ratings in the App Store and Google Play.

Your license to play

We give you a personal, non-commercial, non-transferable license to install and play our games on devices you own or control, as allowed by the store you got them from. The games, their code, art, music, characters, and names belong to us or our licensors. You may not:

Sharing screenshots, score cards, and videos of you playing is fine, and encouraged.

Online play, names, and leaderboards

Some games have World leaderboards, rider profiles, friends, and live races. The nickname, callsign, or profile you choose is shown to other players, so keep it clean: no hate, harassment, impersonation, personal information, or anything sexual. Our filters catch a lot, but not everything.

We may remove or rename names, delete scores, or suspend or end access to online features for anyone who breaks these terms, cheats, or makes the game worse for others. When we can, we'll warn first. Online features need an internet connection and our servers, and they won't always be available.

In-game coins and HASH

Coins, HASH, XP, and items you earn in a game are part of the game, not property. They have no cash value, can't be exchanged for money, and can't be sold, traded, or moved to another player or another game. We may adjust balances to fix bugs, undo cheating, or rebalance the game. You can't currently buy coins or HASH with real money.

Purchases

Games with optional purchases: OVERCLOCK. More of our games may add them.

OVERCLOCK season pass

The season pass unlocks the premium reward track for the season that's running when you buy it. The pass bundle adds a set number of reward tiers straight away. Each season ends on a date shown in the game; after it ends you have a limited time to claim premium rewards you've already earned, and then the pass is used up. A pass doesn't carry over to the next season, so each season's pass is a new purchase. Rewards are in-game items covered by the coins and HASH section above.

Changes to the games

We update our games often. We may add, change, rebalance, or remove features, content, seasons, and offers, and we may eventually shut down a game's online features or stop supporting a game. If we end online play in a game that sells something tied to time, like a season, we'll give notice in the game first and won't sell passes for a season we don't plan to finish.

Ending these terms

You can stop at any time by deleting the game, and by deleting your account in games that have one. We may end your access if you seriously or repeatedly break these terms. The sections on ownership, disclaimers, liability, and governing law still apply afterward.

Disclaimers

The games are provided "as is" and "as available". To the fullest extent the law allows, we don't promise that they'll be error-free, uninterrupted, or that your progress will never be lost, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some games use your device's motion sensors; play somewhere safe and never while driving or walking in traffic.

Limit of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, progress, or in-game items. Our total liability for any claim about our games is limited to the greater of what you paid us for that game in the 12 months before the claim, or $10. Some places don't allow these limits, so they may not all apply to you, and nothing here limits rights you have under consumer protection law.

Governing law

These terms are governed by the laws of the State of New Hampshire, USA, without regard to conflict-of-law rules. Before filing any claim, please email us so we can try to fix the problem; most problems get solved that way.

Apple and Google

These terms are between you and Clocktower Development LLC, not Apple or Google. We, not Apple or Google, are responsible for our games, their support, and any claims about them (including product liability, legal compliance, and intellectual property claims). On Apple devices, Apple's standard Licensed Application End User License Agreement also applies; if it conflicts with these terms, these terms win to the extent Apple allows. Apple has no obligation to provide maintenance or support for our games. If a game fails to conform to any warranty that applies, you can notify Apple and Apple will refund the purchase price of the app, if any; beyond that, Apple has no warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you're not in a country under a U.S. government embargo and aren't on a U.S. government list of prohibited or restricted parties.

Changes to these terms

If we change these terms, we'll post the new version here and update the date at the top. For changes that matter, like how purchases work, we'll also tell you in the game. If you keep playing after a change takes effect, you accept the new terms.
